BREAKING: SCOTUS Upholds Access to Mifepristone via Telehealth, Shielding Nationwide Access – For Now

UNITED STATES – The Supreme Court today issued a ruling preserving access to Mifepristone via telehealth while the lawsuit concerning the drug continues.

The FDA permanently removed in-person dispensing requirements for Mifepristone in December 2021, citing that the proven safety of the drug made in-person dispensing requirements unnecessary.

Since the fall of Roe in 2022, abortion rates have continued to rise. People are seeking abortion care via telehealth at higher rates than in-clinic abortion care — even in most states without total abortion bans.

It’s estimated that telehealth and medication abortion account for 63% of abortions nationwide.

“We will always have abortions, and we will always find innovative ways to ensure our communities across race, place, and financial resources can access abortion. Since the fall of Roe, abortion rates have only risen, and expanded access to telehealth is a big reason why. Proving that science, truth, and justice will always have more strength than lies, shame, and stigma.

“Self-managed abortion and medication abortion via telehealth are safe. That access deserves permanent protection. While today’s decision allows providers to continue serving abortion seekers via telehealth, we are reminded that no Court can grant us power over our own bodies. Only we can grant that power. Providers ensured access to medication abortion before Mifepristone was available by mail, and we know they’ll do all they can to provide care, no matter the future outcome of this case.

“We create our future — not them. That future is a state and nation that celebrates people power and governs with reproductive justice at the center.”

Support for medication abortion remains popular among Americans regardless of political affiliation, with polling reflecting that 68% oppose banning the use of Mifepristone nationwide.

Abortion providers and reproductive health experts assert that misoprostol-only methods for self-managed abortion and medication abortion are a safe and effective option for abortion seekers as well.
